Justice
Parties often expect the court system to provide justice in their case. Unfortunately, this does not always happen. The court system can only give the legally right outcome, based on what can be proven to the judge. Often what is legally right is not what is morally right. Mediation can provide a place to consider the non-legal aspects of a case and take them into consideration of the outcome.
Contested Divorce Mediation
Mediation has many potential benefits for divorcing parties. Parties can make specific decisions about splitting assets, alimony, child custody, etc. Mediation can also be more cost effective and produce faster results then proceeding to trial. In the event that a full settlement is not possible, partial and temporary settlements are generally options as well, so when the matter does go to trial, the judge will have fewer matters to decide for the parties. A mediator can help parties administratively complete the paperwork and help parties consider if all relevant matters have been settled to complete the divorce process in a more timely manner.
No Contest Divorce Mediation
Mediation is also useful in no contest divorces. Parties without lawyers (pro se) often will file for divorce and have it rejected by a judge because the paperwork was completed incorrectly and/or all the relevant matters of a divorce were not settled (i.e. a parenting plan, division of all assets, etc.) A mediator can help parties administratively complete the paperwork and help parties consider if all relevant matters have been settled to complete the divorce process in a more timely manner.
